Digital Millennium Copyright Act (DMCA) Policy 

1. Introduction: Marchup respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), Marchup has implemented procedures for receiving written notification of claimed infringements and for processing such claims in accordance with the Act.

2. Notification of Claimed Infringement: Marchup requires that the notification of claimed infringement be written and include the following information:

• A description of the copyrighted work that you claim has been infringed upon.
• A description of where the material that you claim is infringing is located on the site, preferably with specific URL.
• Information sufficient to allow us to contact the complaining party, such as an address, telephone number, and, if available, an email address.
• A statement that the complaining party has a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Response to Infringement Notification: Upon proper notification of claimed infringement, Marchup will follow the procedures outlined herein and in the DMCA, which typically include the removal or disabling access to the allegedly infringing material. Marchup reserves the right to verify the legitimacy of the claims before taking action.

4. Counter Notification: If the content provider, member, or user believes that the material that was removed or to which access was disabled is either not infringing, or the content provider, member, or user believes that they have the right to post and use such material from the copyright owner, the copyright owner’s agent, or pursuant to the law, the content provider, member, or user must send a counter-notification containing the following information:

• A physical or electronic signature of the content provider, member, or user.
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
• A statement under penalty of perjury that the content provider, member, or user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
• Content provider’s, member’s, or user’s name, address, telephone number, and, if available, email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content provider’s, member’s, or user’s address is located, or if the content provider’s, member’s, or user’s address is outside of the United States, for any judicial district in which Marchup is located.

5. Repeat Infringers: Under the DMCA and other applicable law, Marchup has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. Marchup may also at its sole discretion limit access to the site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Changes to the Policy: Marchup reserves the right, in its sole discretion, to change the Policy under which marchup.net and the Marchup app are offered. The most current version of the Terms will supersede all previous versions. Marchup encourages you to periodically review the Terms to stay informed of our updates. By continuing to use Marchup, you acknowledge and agree to this Policy.
